Kevin provides representation and legal counsel to Liebert Cassidy Whitmore's clients in all aspects of litigation and labor and employment law matters.  His practice includes advising and defending clients in both state and federal court as well as before various administrative bodies.

Prior to joining LCW, Kevin's practice focused primarily on the representation of corporate private employers in both class and individual actions arising from a broad range of labor and employment disputes, including alleged violations of California wage and hour laws, sexual harassment, discrimination, wrongful termination, and retaliation.  Kevin also regularly counseled and defended prominent corporate employers with retail businesses spanning nationally. 

While in law school, Kevin served as a member of the Southern California Interdisciplinary Law Journal and also externed for United States District Court Judge Margaret M. Morrow.

Representative Matters

Litigation

  • Summary Judgement Win On USERRA Claim (2011) - Represented the City on a discrimination suit. Plaintiff alleged the City discriminated against him by violating the federal military leave law, USERRA. Summary judgment granted in favor of City.  Plaintiff's cross-motion for summary judgment denied. The court correctly determined that USERRA does not entitle an employee while on leave to automatically receive promotions or pay increases which are generally based on merit.  The court distinguished job advancement based solely on seniority as opposed to merit.  With pure seniority the employee receives promotion and pay increases "automatically" while on leave.
